Peter Stasiewicz
Counsel

Peter Stasiewicz has over twenty years of experience as a counselor, litigator, and trial lawyer.

He has represented clients in disputes relating to breach of contract and warranty, restrictive covenants, shareholder oppression, breach of fiduciary duty, lender liability, intellectual property, fraud and misrepresentation claims, ERISA violations, complex trust and estate issues, municipal law, and real estate litigation.

Peter graduated from the University of Virginia where he was an Articles Editor of the Virginia Journal of International Law. After law school, Peter practiced at Kirkland & Ellis and Reed Smith, prior to founding Arcturus Law Firm.

  • Principal drafter for a major Taft-Hartley multiemployer health and welfare fund in an ERISA class action in the United States District Court for the Northern District of Illinois involving fiduciary breach and administrative expense allocation claims; secured a complete defense victory on cross-motions for summary judgment.
  • First-chaired an eight-day federal jury trial for Larada Sciences, Inc. in the United States District Court for the District of Utah involving trade secret claims against a former franchisee; secured a $13.5 million verdict.
  • First-chaired trial for a real estate investment firm in the Circuit Court of Cook County involving breach of contract claims; secured a complete defense victory.
  • Represented a real estate investment firm on appeal in the Illinois Appellate Court involving a petition to vacate judgment arising from a breach of contract dispute; secured affirmance of dismissal and sanctions against appellant for frivolous appeal.
  • Represented a protected person in the Illinois Appellate Court involving a motion to vacate a judgment obtained through alleged fiduciary collusion and misappropriation of funds; secured reversal of the trial court’s denial of the motion to vacate.
  • Defended a conservator in the United States District Court for the Northern District of Illinois against breach of fiduciary duty and conspiracy claims involving management of a conservatorship estate; secured dismissal on motion to dismiss.
  • Briefed appeal for a conservator in the Illinois Appellate Court involving a petition to vacate the filing of a foreign judgment arising from a long-running estate dispute; secured affirmance of denial of the petition.
  • Led representation of a minority LLC member in the Circuit Court of Cook County involving freeze-out and governance claims; secured a favorable negotiated buyout and settlement.
  • Led representation of a food testing company in the Circuit Court of Cook County involving breach of warranty claims; secured a favorable settlement following discovery.
  • Represented a major technology company in licensing disputes and related intellectual property matters.
  • Represented a major bank in parallel multimillion-dollar arbitrations involving commercial lending disputes; secured a favorable settlement.
  • Briefed and argued appeal for UAL Corporation in the United States Court of Appeals for the Second Circuit involving securities fraud claims brought by an airline shareholder; secured affirmance of dismissal.
  • Represented an Ethiopian torture victim in immigration proceedings involving a political asylum application; secured asylum despite the absence of documentary evidence.
  • Represented a major commercial lender in commercial lending and real estate disputes.
  • Represented a manufacturer in a bet-the-company contract arbitration involving significant commercial exposure; secured a favorable award.
  • Led overseas document collection at the corporate headquarters of a major energy company in connection with government and civil investigations arising from a major environmental disaster.
  • Represented a major airline as intervenor in a multimillion-dollar labor dispute involving duty of fair representation claims between a labor union and its members.
