Jonathan Silverman

Jonathan Silverman is a trial lawyer who represents companies and individuals in high-stakes commercial disputes. His practice spans complex business litigation, class actions, and matters involving financial services, insurance, and regulatory issues.

Jonathan focuses on cases where the facts are dense and the stakes are real. He has handled matters through all phases of litigation, including pleadings, discovery, dispositive motions, trial, and appeal. He works closely with clients to develop strategy early, with an emphasis on positioning cases for resolution on favorable terms while preparing them to be tried.

Before joining Massey & Gail, Jonathan practiced at leading litigation firms, where he represented clients in federal and state courts across the country. His experience includes defending companies in consumer and commercial class actions, litigating contract and business tort disputes, and advising on litigation risk in complex business transactions.

Jonathan also maintains an active pro bono practice, representing individuals in civil rights and criminal matters.

  • Defeated class certification, secured summary judgment, or achieved favorable settlements in cases involving securities fraud and accounting malpractice claims against a Big Four accounting firm.
  • Obtained reversal on appeal of a denial of a motion to compel arbitration in a securities dispute in Texas.
  • First-chaired a bench trial in an employment dispute involving a real estate brokerage.
  • First-chaired arbitrations for national securities broker-dealers before NASD and NYSE involving employment and commercial disputes.
  • Argued motions in federal and state courts involving non-compete, trade secrets, and fiduciary duty claims.
  • Presented to the Federal Trade Commission, successfully defending client advertising practices under antitrust laws.
  • Prosecuted claims against an errors and omissions insurer for denial of coverage in a putative class action.
  • Defeated a TRO and obtained summary judgment for a real estate developer in litigation with a condominium board.
